Terms and Conditions for the submission of Information and Images to the Screen Scotland Locations Worksbase (The "Database")

Information About Us

The Database is operated by Creative Scotland via Screen Scotland’s Screen Commission’s Locations Services for the purpose of promoting Scotland- based properties and locations as filming locations to professional productions and projects. Creative Scotland is a public body established under the Public Services Reform (Scotland) Act 2010, with its principal office at Waverley Court, 4 East Market Street, Edinburgh, EH8 8BG (“We”, “Us”, “Our”). 

The Database is hosted using software provided by Reel-Scout Inc., a third-party service provider based in the United States. 

By submitting information relating to your location for registration on the Database you agree to be bound by the following terms and conditions (the “Terms”).  

In these Terms, the expression “Works” means identifiable individuals relating to and / or involved with the Screen Commission service, the property, all information relating to the property including contacts and copyright material prepared and uploaded by you to the Database including, without limitation, any information, digital or moving images, film negatives, film positives and film prints. 

Your Warranties

You warrant and undertake that: 

  1. you have the full capacity and authority to enter into these Terms and grant the rights set out in them; 

  1. you own the Works or have obtained all necessary rights and permissions to submit it; 

  1. the Works does not breach the intellectual property rights of any third party and is not defamatory; 

  1. the Works are accurate and not misleading; 

  1. you have obtained all necessary permissions from any individuals identifiable in the Works to enable Us to use the Works in accordance with these Terms; and, 

  1. you will comply with all applicable laws in connection with your submission of the Works. 

Use of the Works and Intellectual Property

In consideration of Us making the Database available, you grant to Us a perpetual, irrevocable, non-exclusive, royalty-free, worldwide licence to: 

  • use, host, store, copy, reproduce, adapt, and display the Works; and 

  • make the Works available to third parties,

solely for the purposes of: 

  • operating, maintaining, and improving the Database content; 

  • promoting locations for film, television and related production activity; and 

  • facilitating enquiries and engagement between location owners and industry users. 

You acknowledge that We may make the Works available via Our websites, partner platforms, and other media channels for these purposes. 

To the extent permitted by law, you waive any moral rights in the Works to the extent necessary for the exercise of the rights granted under this clause. 

Personal Works

To the extent that the Works includes personal data, it will be processed in accordance with Our Privacy Notice (available via Our website). 

You acknowledge that: 

  1. We may process and make available your contact details and other personal data included in the Works to verified industry users for the purposes set out above;  

  1. such processing will be carried out in accordance with applicable data protection law, including the UK GDPR and Data Protection Act 2018;   

  1. We may engage third-party service providers (including Reel-Scout Inc.) to host the data on Our behalf, subject to appropriate safeguards; and,  

  1. you have obtained all necessary permissions from any individuals identifiable in the Works to enable Us to use the Works in accordance with these Terms. 

You must ensure that any personal Works you provide has been collected and shared with Us lawfully. 

Disclosure

We may disclose your identity and contact details where reasonably necessary: 

  • to investigate or respond to complaints or claims that the Works infringes the rights of any third party; or  

  • where required to comply with applicable law or a legal obligation.  

Our Warranties

We will use reasonable endeavours to: 

  1. maintain the operation of the Database; and  

  1. take reasonable steps to verify the bona fides of persons requesting access to location information.  

However, We do not guarantee the accuracy or completeness of any Works. 

Our Liability

Nothing in these Terms excludes or limits liability which cannot be excluded by law. 

Subject to that, We shall not be liable for: 

  • any indirect or consequential loss; or  

  • any loss of profit, revenue, business, or opportunity, arising out of or in connection with your use of the Database or any arrangements you enter into with third parties. 

We do not act as agent, broker, or negotiator in relation to any arrangements between you and third parties. 

Uploading Material to the Database

You are responsible for the content of any Works you upload.

We may remove or suspend access to any Works which We reasonably consider: 

  • to be unlawful;  

  • to infringe the rights of any third party; or  

  • to be inconsistent with these Terms.

You agree to indemnify Us against losses arising from your breach of these Terms or infringement of third-party intellectual property rights. 

Variations

We may amend these Terms from time to time. Updated Terms will be published on this page.  

Jurisdiction and Applicable Law

These Terms shall be governed by and construed in accordance with the law of Scotland. The Scottish courts shall have exclusive jurisdiction.
